Unused sick days make nice parting gift for state workers

When Gov. Rick Scott's jobs czar quit in January only six months after taking the position, taxpayers bestowed him a parting gift.

Doug Darling, a 15-year public employee who rarely missed a day of work, walked out as head of the Department of Economic Opportunity and cashed in his unused sick and annual leave. The payout: $64,000.

The sum is not unusual for high and mid-level state workers, many of whom roll over years of sick and annual leave, then cash it out in a lump sum when they retire, are laid off or are fired. Darling declined to be interviewed for the article.

In the budget year that ended June 30, the state paid out $51.7 million in sick and annual leave to state workers, even as it slashed funds for higher education and public school maintenance. About 28,000 employees left the state during that period.

In incumbent vs. incumbent primary, Rep. Jose Felix Diaz gets Chamber endorsement

Rep. Jose Felix Diaz picked up an endorsement from the Florida Chamber of Commerce on Thursday, as he faces a tough primary battle against another Republican incumbent, Rep. Ana Rivas Logan.

The two Miami Republicans were drawn into the same district during this year's redistricting process, and each is competing for votes and endorsements as the August primary nears. A recent poll showed a close race, with Diaz narrowly ahead.

The Chamber, a powerful business group wielding lots of sway over Tallahassee politics, originally released its list of endorsements on Wednesday, but had not yet made a decision in the Logan-Diaz race for District 116.

On Thursday, when the Chamber weighed in in his favor, Diaz said he was "humbled."

"As the son and grandson of small business owners, I am humbled by the support of the Florida Chamber of Commerce,” he said in a statement. “The Florida Chamber is the premier advocacy group for economic development and job growth in our state. Their endorsement validates and reinforces my unwavering commitment to bringing high-paying jobs and growth opportunities back to Miami-Dade County.”

Former Miami-Dade Commissioner Jimmy Morales eyeing run against Gov. Rick Scott

Add another name to the prospective Democratic candidates for governor in 2014: former Miami-Dade County Commissioner Jimmy Morales.

The Miami Beach lawyer has been talking to Democrats across the state about the prospect of campaigning and argues that he has what it takes to capatilize on the changing political playbook for winning a statewide race in Florida.

"We've got to put some new faces out there, and we've got to reach out to new constituencies," said Morales, 50, pointing to the exploding population of Democratic leaning Puerto Ricans in the Orlando area and the need to excite voters in the Democratic strongholds of Broward and Miami-Dade Counties.

Poll: Most Floridians oppose healthcare law; half want it repealed

A majority of Florida voters oppose the national health care law and half want it repealed, a new Miami Herald/Tampa Bay Times/Bay News 9 poll shows two weeks after President Barack Obama’s signature achievement was largely upheld by the U.S. Supreme Court.

Only 43 percent of voters statewide support the Affordable Care Act and 52 percent oppose it, with 5 percent undecided. With the exception of southeast Florida, more voters think the law will make the health care system worse.

More voters also favor the state opting out of provisions of the law, something Gov. Rick Scott has already said it would do.

And 50 percent want to see Republicans follow through on their vow to repeal the law, with 43 percent saying it should remain.

In perhaps the most worrisome sign for Obama and Democrats, only 39 percent of voters 65 years or older support the law. Seniors make up about 30 percent of the overall state’s electorate.

“Florida voters didn’t like it a year ago, two years ago, (and) they still don’t like it,” said pollster Brad Coker. “There’s nothing there to that suggests health care is a winner for Obama’s people.”

Federal judge holds off on ruling in Miami-Dade state attorney's race write-in lawsuit

A federal judge said he will decide Friday whether to force Miami-Dade County to open up the State Attorney’s Aug. 14 primary election to more than 700,000 Republican and independent voters.

U.S. Judge William Zloch heard arguments Thursday, but stopped short of deciding immediately.

Two voters are suing Miami-Dade’s election supervisor, saying that a “loophole” in the state’s election law that allows write-in candidates to close primary elections is disenfranchising thousands of voters.

Incumbent Katherine Fernández Rundle is facing fellow Democrat Rod Vereen on Aug. 14, a race that would have been open to all voters because no Republicans or independents filed to run. But just before the April filing deadline, two write-in candidates, Michele Samaroo and T. Omar Malone, filed to run.

Neither will appear on the ballot, and neither has actively campaigned.

But under a controversial and much-criticized secretary of state advisory opinion, their entry served to close the primary race to just 525,890 Miami-Dade Democratic voters, making Aug. 14 the defacto winner-take-all race.

Former Broward Teachers Union president arrested after union probe found forged memo

To at least a few Broward Teachers Union board members, it was a hard pill to swallow.

When former BTU President Pat Santeramo resigned in December — a resignation prompted by a pending criminal probe into spending irregularities — the longtime union head demanded to be paid for his accumulated sick and vacation time. The final payout amounted to more than $174,000, and was calculated based on an 11-year-old memo that Santeramo himself had unearthed.

Several board members suspected the memo was a fake — the signature and even the font used in the document just didn’t look right to them.

But board members were no longer in charge. The BTU’s financial disarray had prompted the union’s parent organization, the American Federation of Teachers, to assume control — and that organization was ready to cut Santeramo a check.

“When they made the decision to pay him out, I said, ‘Does it have to be done right this second?’ ” said former BTU executive board member Jeanne Albertus.

The AFT decided it did. In a letter to the union’s rank and file, the parent organization’s newly appointed administrator, John Tarka, wrote that Santeramo was “clearly” owed the money. But Tarka wrote that the payout would be less than the nearly $231,000 Santeramo had initially requested because it had been established that Santeramo was overpaid by $56,419 during his 10-year tenure.

So Santeramo was issued a check for $174,538.70.

“Honoring our commitments is more than a legal obligation,” Tarka wrote. “It’s a statement about our character and a fundamental value we teach our children.”

On Tuesday, prosecutors charged Santeramo with an assortment of crimes ranging from maintenance contract kickbacks to illegal campaign contributions. Santeramo, through his attorney, has denied any wrongdoing.
